Advertiser Terms & Conditions

These Advertiser Terms (“Terms”) govern all advertising, sponsorship, and promotional activities (“Campaigns”) conducted on or through the KultureShock digital platform, operated by KultureShock Marketing West Indies Inc. (“KultureShock,” “we,” “our,” or “us”).

By purchasing, submitting, or placing advertisements on our platform, you (“Advertiser” or “you”) agree to be bound by these Terms and any additional guidelines, rate cards, or campaign agreements mutually executed in writing.

Eligibility & Acceptance

To advertise on KultureShock, you must be a legitimate business, brand, organisation, or representative of one. By submitting advertising material, you confirm that you have the authority to enter into this agreement and that all information provided is accurate and complete.

Ad Submission & Approval

All advertising materials (images, videos, text, sponsored articles, etc.) must be submitted in the required formats and dimensions as specified in our Ad Specifications Guide.

KultureShock reserves the right to review, approve, reject, or remove any advertisement at its sole discretion, for reasons including but not limited to:
Inaccuracy, misleading content, or false claims.
Infringement of third-party rights (copyright, trademarks, etc.)
Offensive, discriminatory, or inappropriate content.
Non-compliance with applicable laws, ethical standards, or platform values.
If materials are rejected, KultureShock will notify the advertiser and may provide an opportunity to correct or resubmit.

Ad Placement & Delivery

Placement of ads will follow the options outlined in your campaign agreement or our published Ad Placement Options, which may include:

Popup, Header/Upper, Middle Content, Sidebar, Article, Sponsored Blog Post, or Footer.
Ads may appear on selected Sections, Pages, Categories, Archives, or Country/Location-based areas according to campaign targeting.
KultureShock reserves the right to make reasonable adjustments to placement or delivery timing to optimise performance or maintain platform integrity.

Targeting & Reporting

Campaign targeting may include factors such as device type, browser language, login status, and geographic location.
Advertisers acknowledge that all metrics, reports, and analytics are based on data available from KultureShock’s reporting systems and are provided for reference only.
KultureShock makes no guarantee regarding specific results, conversions, or return on investment.

Payment Terms

All advertising campaigns must be prepaid unless otherwise agreed.
Payment methods and schedules are outlined in the invoice or campaign agreement.
Late payments may result in suspension or removal of ads.
Fees are non-refundable once a campaign has begun, except in cases of platform error or mutual cancellation agreement.

Advertiser Responsibilities

Advertisers are solely responsible for:

The content, accuracy, and legality of all advertising materials provided.
Ensuring that advertisements comply with all applicable laws and regulations, including but not limited to consumer protection, data privacy, and intellectual property laws.
Maintaining any required licenses or permissions for advertised products or services.

Intellectual Property

Advertisers grant KultureShock a limited, non-exclusive, royalty-free license to use, reproduce, and display submitted materials solely for the purpose of fulfilling the campaign.

Advertisers retain ownership of their content but agree that KultureShock may archive or showcase campaign work for portfolio and promotional purposes unless otherwise requested in writing.

Prohibited Content

The following are strictly prohibited:

Misleading or fraudulent claims.
Pornographic, obscene, or hateful content.
Political or religious ads not related to historical, cultural education or events.
Content promoting illegal activities or unsafe practices.
Ads infringing on third-party intellectual property.

KultureShock reserves the right to remove such ads without refund.

Performance & Availability

While KultureShock will use reasonable efforts to maintain consistent ad display and uptime, we do not guarantee uninterrupted service.
Temporary downtime or maintenance may occur without prior notice.
Advertisers acknowledge that performance may vary due to factors beyond our control (e.g., user behaviour, external traffic sources, or third-party platforms).

Data & Privacy

KultureShock may collect and process campaign performance data, which may include anonymous user interactions, clicks, and geographic information.
No personally identifiable information (PII) will be shared with advertisers unless explicitly authorized by the user in compliance with privacy laws.

Termination & Cancellation

Either party may terminate a campaign with written notice.
If the advertiser terminates before completion, KultureShock may charge for all ads already delivered and associated costs incurred.
KultureShock may terminate immediately if an advertiser breaches these Terms or damages the integrity of the platform.

Disclaimer & Limitation of Liability

KultureShock makes no warranty regarding specific results from any advertisement.
We are not liable for indirect, incidental, or consequential damages arising from campaign performance, service interruptions, or technical issues.

Updates to Terms

We may update these Terms periodically to reflect operational, legal, or technological changes.
Any updates will be posted on this page, and continued use of advertising services constitutes acceptance of the revised Terms.
